CONTRACT OF SALE AND HEALTH WARRANTY
This document constitutes a contract of sale entered into on the ____day of __________ between Richard and April Moller (herein referred to as Seller) and _____________________(referred to as Buyer(s) for the purposes of setting for the terms and conditions of the purchase of a Golden Doodle puppy known as __________________ Purchase price of _______cash____paypal______.
CONDITIONS OF SALE:
___1. Seller warranties that above dog has been examined by a licensed veterinarian and found to be in good health.
_____2. Seller to send/deliver/allow pick up when payment is guaranteed.
___ 3. Seller guarantees that the above dog is to be free from severe hip dysplasia determined at 2 years of age and not before or after 2 years of age, by x-ray and evaluation of the Orthopedic Foundation for Animals (OFA). All x-rays must be done by an experienced veterinarian. We reserve the right to examine x-rays and have our veterinarian approve them. This does not include hip deformation or abnormalities caused by injury, poor quality food, over exercise and jumping during their growth period (1 1/2 years), due to being overweight, has not been overfed for its height/structure, or malnutrition.
___ 4. If the dog is found to be dysplastic, the Buyer(s) must notify the Seller immediately and provide appropriate documentation from OFA of defect. Dogs with a rating of Excellent, Good, Fair, and Borderline are not considered dysplastic. After these qualifications are met, the seller will at the seller's sole discretion, provide a replacement puppy of equal or lesser value from her next available litter, with the return of said puppy. Or refund no less than 100.00 or more than half the purchase price of the puppy (this excludes shipping costs). We are a small breeder and it may take up to 12 months to receive any reimbursement. Proof of any congenital defect must be provided to the seller from a qualified veterinarian. Seller reserves the right to a second opinion on all health issues.
___ 5. Buyer will spay or neuter puppy .
___ 6. Buyer(s) agrees to have puppy examined by a veterinarian within the first 3 days, or said warrantee is null and void. Buyer agrees to notify Seller of any health problem immediately after exam. Puppy is warrantied against any genetic disabling or life-threatening defect for 2 years. If puppy is found to have a disabling or life-threatening genetic defect the Buyer(s) must notify the Seller immediately and provide appropriate documentation from a qualified veterinarian. After these qualifications are met, the seller will at the seller's sole discretion, provide a replacement puppy of equal or lesser value from her next available litter, with the return of said puppy, or refund no less than 100.00 or more than half the purchase price of the puppy (this excludes shipping costs). We are a small breeder and it may take up to 12 months to receive any reimbursement. This limited warranty applies only to genetic disabling or life-threatening defects and does not include parasites. Breeder will accept the return of the puppy if the puppy has not been exposed to infectious disease of any kind. Breeder will replace the puppy provided that the puppy is in the same condition mentally and physically as when originally purchased from the Breeder.
This warranty is nontransferable.
This is the extent of the warranty from seller for said puppy/dog.
___ 7. Buyer(s) agrees to feed a dog food of good quality, complete puppy shots, give yearly vaccinations and heart worm medication along with a SECURE area for exercise.
___ 8. BUYER AGREES THAT THE PUPPY IS NOT FOR RESALE. If for any reason buyer is unhappy with puppy or can not keep the puppy, buyer agrees to notify seller and to return puppy to the seller at the sellers discretion. If for any reason the buyer is unable to keep said puppy/dog at any time in the future, seller agrees to help rehome the puppy/dog. Buyer agrees to never surrender said puppy/dog to a shelter, humane society, or animal rescue group.
___ 9. Any disputed claim regarding the limited warranty for this puppy must be submitted in writing to the seller for reconsideration. Claim must be submitted within 60 days of the seller's determination. The seller will promptly provide a written explanation of the decision on your request. Requesting reconsideration is a prerequisite to any other action in order to dispute the seller's determination, including the filing of a civil suit. Any legal action regarding this limited warranty must be brought against the breeder in a court where the breeder is located and is subject to only the laws in the state where the breeder resides.
